True Life “Scarface” Conspiracy – An Unbelievable Story

We’ve said before that we couldn’t make this stuff up if we tried!  Well, the whole Nutragenomics/Pinnacle Products/Curious Goods plot thickens . . . . . . . SUBSTANTIALLY!!!

This is a tangled story involving Synthetic drug dealing, shady “trade associations,” illegal sales, conspiracy, pay-offs, money laundering, federal indictments, and now, a new twist! Stick with us while we give you a synopsis of the story, which we’ve written about, previously.

If you can stay with this twisted tale, we’ll share new information , including how some of these drug dealers employed a former government counter narcotics intelligence officer, George Wilson and other tidbits.

It all started when Georgia teen, Dakota Blaze Dyer, tragically took his life after ingesting a synthetic cannabinoid (Spice) product called “Mr. Miyagi” on March 10, 2012.

That product was manufactured by Nutragenomics, a company which was controlled by Drew Green and Thomas William Malone, Jr., son of famed Atlanta, Georgia Attorney, Tommy Malone.

We knew that the company was up to no good, and so did the state of West Virginia, which filed an injunction against Nutragenomics in April 2012 to  ban them from doing business in WV after several deaths were linked to the company.

Nutragenomics was also in the “Bath Salt,” synthetic cathinone industry.  Deborah Walton says that one of the company’s products was responsible for the death of her sister, Pamela Harmon.  ”She was so beautiful,” Walton said. “And for somebody to make this crap and make money off of it and for people to die because they’re making money it’s not fair, it’s not fair to the families.”

On July 25, 2012, the DEA and eight other government agencies, conducted a sting which included Nutragenomics and Curious Goods.  No one was arrested, but authorities seized company records, products, equipment, and computers.

The Indictment

On September 4, 2012, the U.S. Justice Department handed down that indictment naming:

• Alexander Derrick Reece, 40 of Gainesville, Fla.;
• Drew T. Green, 38 of Roswell, Ga.;
• Thomas William Malone, Jr., 45 of Roswell, Ga.;
• Boyd Anthony Barrow, 43 of Canton, Ga.;
• Joshua Espinoza, 49 of Marietta, Ga.;
• Richard Joseph Buswell, 44 of Lafayette, La.;
• Daniel James Stanford, 54 of Lafayette, La.;
• Daniel Paul Francis, 42 of Dawsonville, Ga.; and
• Barry L. Domingue, 52 of Carencro, La.

Drew Green and Tommy Malone were the first two defendants to plead guilty and admitted to:

• Selling their poisons to customers in 25 states
• Selling more than 10 million dollars in synthetic cannabinoid poisons from March 1, 2011 to July 25, 2012 (the day of Operation Log Jam),
• Packaging for human consumption but with intent to mislead as to what was in the product and the products intended use by calling it potpourri or incense and labeling it “Not for Human Consumption”
• Conspiring with the others to perform knowingly unlawful acts for an unlawful purpose

….all for the sole purpose of getting the end user “high”.

Boyd Anthony Barrow

Barrow and Espinoza, the second two to have plead guilty, through their company, Pinnacle Products, manufactured and distributed Mr. Miyagi, their line of synthetic marijuana.

Of the numerous businesses supplied by Barrow and Espinoza, their biggest customer was Curious Goods, owned by Richard Buswell.

Daniel Paul Francis

Daniel Francis, through his ‘trade association’ of drug dealers, the Retail Compliance Association (RCA),  advised and trained Curious Goods employees and Buswell on how to detect and evade law enforcement, store synthetic drug products, and respond to customer inquiries without implicating themselves.

Alexander Reece

Alexander Reece, through his companies, Ski Blue International Broker and Mountain Industries, supplied Drew Green and Tommy Malone’s, Nutrogenomics.

Daniel Stanford

Barry Domingue

The indictment says that Attorneys Daniel Stanford and Barry Domingue trained, advised and instructed the employees of Curious Goods and Buswell on how to store, display and sell synthetic drugs, and respond to customer inquiries on how to use the product without getting themselves into legal hot water. They also educated them on how to detect and evade law enforcement. (Hmmmm!  Sounds more like the consigliere for a mafia family.)

It should be noted that communications between a client and his attorney regarding future crimes are not protected under “attorney client privilege.”

Stanford and Domingue are no strangers to the wrong side of the law . . . more on that, later!

Business Partners: Green, Malone, and Francis

If you think that this story is complicated enough now, consider the involvement of Green,  Malone, and Francis in multiple business ventures: The Coalition of Cognitive Liberty (another “trade organization”), Nature’s Euphoria (sexual enhancement supplements and synthetic drugs), The Pam Green Foundation (a non-profit organization to help the drug addicted), and 13 Black and The Dungeon Family (hip hop recording labels).

The Pam Green Foundation

Green, is the founder and president of The Pam Green Foundation, a non-profit organization that “helps” drug abusers, and Malone and Francis sit on the Board of Directors. Pam Green was Drew Green’s mother.

One goal of the Pam Green Foundation is to “fund research into various research chemicals.”  “Research Chemicals” is a code word for synthetic drugs.  So, to sum this up:   drug dealers, who sell synthetic drugs that contribute to mental illnesses and addiction have founded an organization to “help” the mentally ill and drug addicted through research into synthetic drug chemicals.  Yep!  It’s true!!!

David Lushbaugh

A new twist is that convicted drug dealer Drew Green was advised by David Lushbaugh, who serves on the National Board of Directors for the National Alliance on Mental Illness (NAMI); was the founder of NAMI, Georgia;  is a member of the American Foundation for Suicide Prevention Metro Atlanta Board of Directors, has served on the Emory University Community Psychiatric Services Fellowship Board, and is published in the Journal of the American Academy of Psychiatry and the Law.

Lushbaugh also owns the actual home and property for the Pam Green Foundation House, which is an in-patient home for the mentally ill and drug addicted, at 7670 Colquitt Rd., Sandy Springs, Georgia. Lushbaugh was recently cited for breaking Sandy Springs zoning and codes laws as owner of the house.

Interestingly, David Lushbaugh developed national response protocols for NAMI for responding to mental illness crisis events.  He is an expert for NAMI about mental illness as a result of substance abuse, and he’s been a speaker at professional conferences hundreds of times.

Synthetic drugs are causing Mental Illness Crisis Events across the country and are contributing to mental disorders, including panic and anxiety disorders, psychosis, and dissociative disorders.

David Lushbaugh seems the least likely person in the world to associate with the likes of Drew Green and Thomas Malone, Jr.  To the Maximus Foundation wonders why Dr. Lushbaugh didn’t distance himself from Green and Malone after the initial federal indictments.  Wasn’t he aware of who he was dealing with?

Coalition for Cognitive Liberty

Green also founded the Coalition for Cognitive Liberty with Daniel Francis as Executive Director.  In their own words, the Coalition ”was formed to protect the rights of businesses in the incense industry. The government seeks to regulate or ban incense products, the Coalition for Cognitive Liberty seeks to stop them.”

This is another “trade association,” like the Retail Compliance Association, and we can’t help but wonder if this “trade association” might be guilty of the very same activities.

We find the name of the Coalition ironic because everyone that’s ever known someone addicted to synthetic drugs will attest to the fact that they have lost every bit of “cognitive liberty” they had.

Hip Hop Labels

Also, very noteworthy is that Green and Malone are managing directors of 13 Black and The Dragon Family, which are hip hop/R&B/soul musical collectives, based in Atlanta, Georgia.

The groups have produced hits from Hip Hop Superstars OutKast, Cee Lo Green, Sleepy Brown and Goodie Mob, among many other artists.

Some Interesting Connections

All together, Green and Malone are involved in at least 11 companies. We continue to discover more companies founded by these characters.

As we follow the money, we uncovered more and more fascinating facts about Green and Malone’s business dealings and how their drug connections might have played a part.

For example, Jared Brague is CEO of True Verticle and a managing director for Nature’s Uphoria.  Tommy Malone founded True Vertical, LLC., and IMPulse, Inc. which are marketing companies managed by himself, Brague and Wilson George.

Wilson George claims to be a “technical professional” for the company.  He was with the U.S. Coast Guard for 17 years in tactical law enforcement as a Counter Narcotics Intelligence Officer.

Yes, that’s right!  Self-admitted and convicted drug dealer, Tommy Malone hired Wilson George, a former Counter Narcotics Intelligence Offices, in February of 2012. To The Maximus wonders in what respect Wilson George served in Green and Malone’s companies.  Why would someone who has spent 17 years fighting against drug dealers, suddenly work for/with a self-admitted drug dealer?   We can’t think of a single answer to this question that would justify his involvement with Malone.  However, we can think of plenty of reasons why George would have an illegitimate involvement with Malone.  Even after Malone was indicted for conspiracy and drug trafficking  and subsequently plead guilty, Wilson continued his employment with him.  At this point, nothing would surprise us.

We’d like to share some wisdom with Mr. George from one of our mothers, “You lay down with dogs, you get fleas.”

Daniel Stanford

Dan Frances sold an RCA franchise to Stafford for business in Louisiana.

Attorney Daniel Stanford is no stranger to the wrong side of the legal table. He was suspended from the practice of law in Louisiana for six months on October 19, 2010.  His sentence was deferred, subject to the condition that he enroll and attend Ethics School offered by the Louisiana State Bar Association’s Practice Assistance and Improvement Committee.

Why, you say?  Again, we couldn’t make this up if we tried.

Stanford was co-counsel for a criminal defendant charged in Lafayette Parish, LA with two counts of aggravated, incestuous rape, in which one of the victims was the defendant’s sixteen-year old daughter.

At issue was a meeting Stanford helped arrange with the victim, identified as D.T., and her father, Darryl Theriot, their client. At the meeting, Stanford presented D.T. with three documents to sign. They included an affidavit asking the District Attorney’s office to drop the charges against Darryl Theriot, another affidavit asking the court to relieve any order preventing Darryl Theriot from visiting with his daughter while charges were pending against him, and a “Confidentiality Agreement,” stating that the two parties, D.T. and her father, agree not to say anything about the meeting upon penalty of “all costs, expenses, liabilities and fees, including attorney’s fees, that may be incurred as a result of such breach.”

The Supreme Court of Louisiana found that Stanford intended to create the impression in the victim’s mind that the confidentiality agreement legally barred her from testifying in the criminal trial about a meeting with her father, and the statements made in the meeting.

Back to synthetic drugs……

Stanford admitted, in one of his interrogations, to meeting Rick Broider, a huge big player in the synthetic drug industry, at a Mixed Martial Arts event in Las Vegas.  Several of our bad boys were in town together for the CHAMPS trade show in Las Vegas, which is a “counterculture” expo featuring marijuana products.  In 2011, CHAMPS had a whole section for the synthetic drug market.

In a side note, we called the CHAMPS  offices regarding their 2012 expo, inquiring about whether they would be continueing their synthetic drug sales at the expo.  We were told that they would have “free flights in free rooms.”  When asked what “free flights” were, he hung up.

Back to the other scum bags……

Barrow and Espinoza acknowledged in court, when pleading guilty on November 13, that the packaging of Mr. Miyagi was “designed and placed on the product to be intentionally misleading as to both what was in the product and what the product’s intended use was knowing full well that it would be ingested by humans.”  Malone and Green had made the same admission during their plea appearances.

The feds have moved to seize more than $20 million in cash the defendants received either directly or indirectly from the drug trafficking ring, a 2006 Mercedes Benz X65 sedan, a 2005 Baja Outlaw speed boat, and 2002 Pontiac Firebird (the owners were not listed), and Stanford’s home at 120 Branton Drive in Lafayette. According to the tax assessor’s office, the home is valued at $572,000.

Dakota Dyer’s life was worth more than $20 million, a home, a boat and a few cars.

Remember we mentioned Malone’s father, the famed Atlanta, Georgia attorney? In one of his closing statements, he mentioned a Van Gogh painting that had sold for $53 million.  “Mere paint on canvas,” which he compares to his client,  “a precious child, one of the greatest works of the greatest master of all time.”

Malone’s father won a $45 million dollar judgement in that case.

We wonder if Daddy Malone will agree that Dakota’s life was priceless, as well.  We know what Dakota’s father, Lance, would say.

Update:  On December 21, 2012 Karen Dobner received two cease and desist letters from.  Her response to this legal threat has caused enormous response from Georgia media and several of the parties involved.

This story is still growing, so don’t go too far.  There are still some facts that we are working to confirm and will report as they become available for publication.
